1. The service

RainCheck ("the Service") is a software tool for recording and organizing stormwater inspection activity on construction sites, including rainfall monitoring, inspection scheduling, inspection records, photographs, reports, and document storage. The Service is provided by RainCheck ("we," "us").

2. Not legal or compliance advice

RainCheck is a recordkeeping tool, not legal, engineering, or compliance advice. Stormwater permit requirements vary by state, permit, project, and time. Default thresholds, inspection frequencies, and state summaries in the Service are provided for convenience and may not reflect the current requirements of your permit. You are solely responsible for verifying all requirements against your permit and SWPPP, and for your compliance with all applicable laws. Rainfall data displayed by the Service comes from third-party weather models and may differ from measurements at your site; where your permit designates an on-site rain gauge as the system of record, that gauge controls.

3. Your account

You are responsible for the accuracy of the information you and your team enter into the Service, for maintaining the confidentiality of your credentials, and for all activity under your organization's account. You must have the authority to bind your organization to these terms.

4. Billing

Paid plans are billed monthly per active site through Stripe. Trials convert to paid subscriptions only after you add a payment method. You can cancel at any time; access to paid features ends at the close of the billing period, and your records remain readable.

5. Your data

Your inspection records, photos, and documents belong to you. We store them so you can retrieve them; we do not sell them. You can export your records at any time using the Service's report and binder exports.

6. Availability and limitation of liability

We work to keep the Service available and alerts timely, but we do not guarantee uninterrupted operation, delivery of any notification, or the accuracy of third-party weather data. To the maximum extent permitted by law, the Service is provided "as is," and our total liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for fines, penalties, enforcement actions, or other consequences of your compliance or non-compliance with any permit or law.

7. Changes

We may update these terms; material changes will be announced in the Service or by email. Continued use after changes take effect constitutes acceptance.
